On May 19, 2017, Reverend Canon Herbert Tumwine secured an eviction order from Masaka High Court cementing his ownership of a piece of land located at Kanoni village in Ntusi sub county in Sembabule district. It measures about 400 acres. It is home to primary school, a community well, an access road and people's homes and farms and gardens.
 
Information obtained from Sembabule district land board indicates that this land initially belonged to the family of one George Ssendaula who also donated part of it measuring about 20 acres to Kanoni Church of Uganda.
 
Ssendaula protested the court ruling and filed a notice of appeal saying Tumwine used his position as chairman of Ntusi Area Land Committee to secure land title deeds for the land.
 
Last week, using Uganda Peoples Defence Forces (UPDF) soldiers from Masaka Armoured Brigade, Canon Tumwine started forceful eviction of the residents sparking off public protests. 
 
The affected residents stormed his home located next to Kanoni Church of Uganda and threatened to set it on fire.
 
The angry residents, many of them members of Kanoni Church, also lit a fire place on the disputed land as a sign of mourning for their eviction. The angry Christians have vowed not to leave the land but want Canon Tumwine out of the Archdeaconry.
 
Ssendaula admits that he has no land title but has all the agreements from his late parents who owned this land since the 1930s. He says he has already filed a notice of appeal protesting against annexation of his land to Kanoni Church of Uganda.
 
According to Ssendaula, Stella Atingu, the assistant Masaka High Court registrar issued the eviction notice without even visiting the disputed land.
 
Abraham Kaweesi, one of those affected says he was harvesting maize from his one-acre piece of land when Canon Tumwine arrived with soldiers. He was arrested and taken to Masaka Army Barracks.
 
Kaweesi, who has lived on this land for 40 years, says he has known only one land lord George Ssendaula.
 
He alleges that when he protested, soldiers beat him and his wife.

Charles Lubyaayi, another resident says they lived peacefully with previous religious leaders at Kanoni Church of Uganda until Canon Tumwine came. He claims that the reverend canon first sealed off part of the church land where they fetched water from.
 
Henry Baguma, the Sembabule Resident District Commissioner, says he has stopped the evictions. He explains that while court has supremacy over them, those enforcing the eviction did not inform his office.
 
Baguma says he has stopped the eviction because it was being implemented at night.

Gabriel Ddungu, a Christian at Kanoni and one of those affected says now that majority of them have turned against him, Canon Tumwine must be transferred. Ddungu claims that lately, Canon Tumwine has been coming to church while carrying an AK47 rifle.

Lt. Geoffrey Sande, the the Spokesperson of Masaka Arrmoured Brigade where some victims claim were detained said he is not aware. He noted that he is new in the area and he needs to first establish what happened from his bosses.

Lameck Kigozi, the Southern Region Police Spokesperson referred this reporter to his boss Latif Zaake, the Southern region Police commander who declined to comment when contacted.

 
Canon Herbert Tumwine, however, says residents have been incited by politicians. He said in a phone interview that he was at his home but when Uganda Radio Network visited his home located next to Kanoni Church of Uganda he was not there. His house was closed.

However, Canon Enock Muwanguzi,the Spokesperson of West Buganda Diocese said he would not discuss at now because it is a very long story. He instead said he was still very sick and admitted but when he recovers they will arrange and respond.

 
Information obtained from the office of the RDC indicates that every month, at least 200 land related cases are reported in the area.
