Little-known lawyer Severino Twinobusigye may be about to get one of the biggest windfalls in Uganda's civil litigation history, after Attorney General Peter Nyombi failed to appeal a Shs 13bn court award.

Last year, Twinobusigye successfully petitioned the Constitutional court to cancel a Parliamentary resolution ordering three ministers implicated in an oil bribery scandal to vacate their jobs. MPs had forced Prime Minister Amama Mbabazi and Ministers Sam Kutesa and Hilary Onek, to step aside to allow investigations into allegations of bribery against them.

Although the figure shocked the nation when it became public, taxpayers may lose money because the Attorney General failed to appeal against last February's ruling within the stipulated 30 days. Twinobusigye, who calls himself a Mbabazi supporter, was awarded the costs after his lawyers Chris Bakiza and John Mary Mugisha argued that the petition had been complex and entailed extensive research.  The trio are now part of the four lawyers, arguing on behalf of the NRM, for expulsion of four MPs from Parliament.

At the time, the AG protested the taxation ruling, contending that it was astronomical. He indicated that he would appeal, but he did not do so five months later. Two weeks ago the AG's office finally petitioned the court of Appeal, asking to be allowed to appeal out of time.

The Director for Civil Litigation, Cheborion Barishaki, pleaded that the government delayed to appeal because they learnt about the taxation award from New Vision newspaper of February 19, 2013, almost a year after the ruling was made. He claims government was never served with the taxation ruling notice, but there is real danger that taxpayers may lose out.

Attorney General Peter Nyombi last week declined to comment on this matter, saying he was out of the country. Fred Ruhindi, the deputy Attorney General declined to say much, a arguing that the matter was too sensitive. However, Twinobusigye has asked court to dismiss the petition, so that he could get the money. He claims the Attorney General has not showed any interest in the matter.

His lawyer Mugisha told The Observer that the reasons advanced by the Attorney General to allow him to appeal out of time were too weak and that court would ignore them.
Justice Augustine Nshiimye is presiding over the case.

What a robber he is to us the people who struggle to pay taxes.
