A High Court advocate has blamed the misunderstandings within the 2010 Kampala Capital City Authority Act and the confusion at City Hall on Parliament.

Testifying before the tribunal investigating the Lord Mayor's conduct, Mr Peter Muliira yesterday said the draft dossier of the Bill they submitted to the concerned authority was doctored and did not fully envisage their views.

"Parliament went against the Constitution when it passed the KCCA Bill. The original document we drafted as a committee that captured our views was doctored and about 20 per cent was dropped," he said.

Mr Muliira, who was summoned to give technical advice said: "As Hon Betty Nambooze said before in her testimonies to this tribunal, Parliament rushed the whole issue of passing the Bill." "It (Parliament) created two centres of power. On one side you have the politicians vested with equal power and on the other side, the technical team has the same powers," the lawyer added.

Mr Muliira told the tribunal probing Mr Erias Lukwago for alleged incompetence, that he is a senior advocate of the High Court, adding that he has been in legal practice for 40 years. Mr Muliira said he is a senior lawyer with respected integrity. The New Vision reported on August 23, 2008 that he was arrested for allegedly failing to remit more than Shs1.2b that he received on behalf of Mittchell Cotts Limited.

Mr Muliira also said the original proposed Bill provided for a situation where people like Mr Gordon Wavamuno who are not "political animals" would be elected to the council without getting into the "dirty politics, but that was doctored out of it". "… I am not saying the current Lord Mayor be removed. His office could be turned into an executive mayor and the executive director on the other side with powers completely separated as we had proposed...," Mr Muliira said. He said there was only one Lord Mayor in the world who heads the House of Lords in London.
