why cant Frank Tumwebaze make a public apology for his conduct? The looming censure motion is quite meritorious, in the sense that the proposed censure is based on reliable facts and proper appreciation of the the relevant provisions of the Constitution and Law.
Article 118(1)(a) & (e) of the Constitution of Uganda states: "Parliament may, by resolution supported by more than half of all members of Parliament, pass a vote of censure against a Minister on the grounds of abuse of office and incompetence."
why cant he emulate the good examples of former cabinent minister like Kabakumba Matsiko, Mathew Rukikaire, Kirunda Kivejinja, Khiddu Makubua and others, to avoid further embarrassments?
Article 114(b)(i) of the Constitution of Uganda 1995 states: "The office of a Minister shall become vacant if the holder resigns.Article 118(2) provides: "Upon a vote of censure being passed against a Minister, the President shall, unless the Minister resigns his or her office, take appropriate action in the matter."
Section 117 of the Penal Code Act ["PCA"] created the penal offence of disobedience of lawful court orders. Section 117 of the Penal Code Act ["PCA"] created an express alternative statutory response to acts of court contempt resulting from disobedience of a lawful court order.Section 117 of the Penal Code Act ["PCA"] provides: "any person who disobeys any order, warrant or command duly made, issued or given by any court, officer or person acting in any public capacity and duly authorised in that behalf commits a misdemeanour and is liable, unless any other penalty or mode of proceeding is expressly prescribed in respect of such disobedience, to imprisonment for two years."
Section 112 of f the Penal Code Act says: "Any person who wilfully obstructs or resists any person lawfully charged with the execution of an order or warrant of any court commits a misdemeanour and is liable to imprisonment for one year."
