{UAH} Re: [UNAANET] Response to RUTEHENDA: Update on UNAA's Petition

"... since the BOD, Council and Executive get their mandate through the current constitution..." Rutehenda Is it an error or is it deliberate for the young man to pretend or Confuse this forum that UNAA has an existing BoT, council and a legal constitution!? Not only is the document illegal but it has been violated and abused to the point that out of the three UNAA organs two are practically dissolved and another is a lame duck. All in courtesy of Brian Kwesiga and his boss Moses Wilson. What will happen if the judge rules in favor of Musokea petition? Of course, that becomes UNAAs victory. Kamugisha

I didn't look at the laws of Massachusetts until Moses Wilson decided to extend his term on the Board yet it expired in Sept, 2014. That is when I discovered that the whole document was passed in passed in violation of state law and has several unlawful provisions.

>>Ronald, it's electronic filing. You can file anytime. Still, I'm abused by the fact that you're very interested in when I'm filling the petition but you're not bothered by the fact that you and I are UNAA members and we can have this exchange on this forum but we can't do it on UNAA's official discussion group (unaalist) just because Tim Gaburungyi blocks most people like me that point out wrongs in your camp? Thanks

>>On November 4th, 2014, a petition signed by several members of UNAA was delivered to the UNAA Executives. The petition demanded that UNAA leaders have to do before November 18th, 2014:
>>1. UNAA Executives should inform members that the current constitution is illegal because its adoption did not follow state law. In addition, several articles of that 2010 constitution are illegal.
>>2. the UNAA Board of Trustees, the Council and the Election Commission should be disbanded immediately because they were created under an illegal 2010 constitution.
>>3. Timothy Gaburungyi must be removed from control of UNAA's website and UNAA's mailing list. Timothy Gaburungyi has abused his powers and blocked several members from unaalist. e.g he he has never explained to me why he blocks me.
>>4. a special UNAA meeting must be called before December 19th, 2014 to address the above matters.
>>State law provides that a special meeting can be requested by members representing at least 10% of the smallest quorum of members needed for a vote at the annual meeting. Article 4.4 of UNAA's constitution provides that there is NO quorum neded for a vote at the annual meeting. i.e even one UNAA members can vote by himself and bind UNAA. Therefore, one member is enough to call for a special meeting under state law since that would be equal to or greater than the 10% that the law requires for calling special meetings.
>>In case the Executives ignore the petition, we have drafted an application that we will send to a court in Massachusetts requesting the power to call a special meeting.
>>We will basically inform the court that we know that our constitution is illegal and we had requested our leaders to address the above issues but the leaders ignored our petition. We anticipate to go to court on December 20, 2014 and we will post the whole document on this forum.
