Githu Muigai: I didn't draft the anti-terror rules - Politics

Attorney-General Githu Muigai has explained his peripheral role in the enactment of the new security laws whose key clauses the the High Court suspended on Friday.

Prof Muigai, in an interview with the Saturday Nation, said he was not at the forefront of defending the laws since he was not part of the team that drafted the controversial legislation.

He said the new laws were a joint initiative of the Executive and a parliamentary committee, where the Solicitor-General Njee Muturi was involved.

Prof Muigai, however, said he fully supported the anti-terror laws, allaying speculations in the media that he was sidelined.

"I don't draft every law, but I supervise the process," he said, and added that the drafting of Security Laws (Amendment) Act 2014 happened when he was engaged in other duties.

Prof Muigai described Mr Muturi as "a very valued member of my team," and bemoaned the fact that the culture of preparing the next generation leaders by delegating work has not gained currency.

Parliament passed the anti-terror laws on December 18 amid uproar that the legislations infringed on basic rights and freedoms, and were unconstitutional.

President Uhuru Kenyatta assented to the laws the following day.

Cord filed a petition at the High Court resulting in Friday's suspension of implementation of some of the clauses.

In the courts, the government was represented by Director of Public Prosecutions Keriako Tobiko and Mr Muturi.

"We were all aware of what was happening," said Prof Muigai, and added he supported the decision to make security laws responsive to emerging threats.

"Public officials should be allowed to work without feeling scared that they'll be shouted at," he said alluding to the public outcry that follows when government officials make unpopular decisions.
