{UAH} PUTATIVE TRIBES COULD FORM A STATE WITH EXCEPTIONS.

The characteristic of a state is very vital in the entrenchment of the desired balance of power, between the central and local government. The question however we have to deal with first are;

a) Whether all important governmental decisions affecting people's lives and livelihood should be taken in one place on the basis of national policies; or whether many of the decisions could be taken in different places, by people of diverse experience, associations, background and political persuasion.

b) How can we ensure that the desired balance of power between central and local government is sustained; can we entrench it through codified constitution or organic fundamental laws or an act of parliament where statute is supreme?

c) What would be the basis of financing the federal system in order to balance the power?.


UgandaFedby20/20 proposes public discussion a three tribe state approach to balance the need for integration economic success, demography and continuity in local relations. It is the case that most tribes of Uganda have neighbours to their left and the right, and it's rightful that from this natural  arrangement be the basis upon which an entity in form a of states, should be made. For instance in the West Nile region, there are the Lugbara, Kakwa and Alur as distinct tribes with marked customary difference but similar geographical sphere. The three tribes should therefore fore a state, The Nile State. As aforementioned, the basis should consider among others economic success and therefore a region like Buganda, should remain as a stand alone state,  on the basis of it's preponderous economic muscle and population. To integrate Buganda with any other tribe, would cause an imbalance that would weaken the federal spirit. As a balance, Kampala would form an entity by itself as national administrative capital. This arrangement would provide continuity from the current situation.

The crucial need for decentralisation is the empowerment of local people to decide on local issues, because ultimately it;s they who get affected by decisions made, locally or otherwise. It's important that decision should not adversely affect people regardless of where they are. So it's vital that local people be given the mandate to decide on issues that affect them. Any regional arrangement should be for life and this means that it should be through codified constitution so that every state is equal to the other and rights of nationals protected wherever they are. A statute is temporal and can be revoked, taking the country back to unitarianism, where the central government control local government as if it were a division of central government. This arrangement, will be overseen by a bicameral parliament of a lower house and an upper house, comprising elected members from the state. Legislators to the upper house will be elected in a rotational manner within state. Both houses will be checked by the constitutional court to balance.

The central government should be the financial granary, where monies collected from the state is deposited. Each state will be required to deposit a percentage of their revenue collection with the central government, to undertake it's function and to redistribute monies wherever it's needed.  

These are some rough ideas to be built on by Ugandans who want a nation free of dictatorship, where rule of law, fundermental rights and the decision made by all, is the norm. Ugandafedby20/20 raises these questions well aware that the federal spirit is now in the air and there is need to address the issue. Continually ignoring what one half of the country is imbued with, is recipe for disaster.
