Senior pathologist Dr. Sylvester Onzivua who examined the body of deceased Butaleja MP Hon Cerinah Nenbanda in 2012, has gone to court seeking damages totalling to 100 million shillings over malicious prosecution.
On September 18th 2013 both Dr Onzivua and Dr Chris Baryomunsi were acquitted of the charges related to unlawful obtaining of body parts from the fallen MP, which they had extracted with the intention of taking them to south Africa without permission to establish the cause of her death
Dr. Onzivua through his lawyers of KMA and company advocates says government maliciously prosecuted and detained him for the alleged abuse of office and conspiracy with Kinkizi East MP Baryomunsi to steal body samples of the late Cerinah Nebanda..
He says that he was appointed by the speaker of parliament Rebecca Kadaga to join a team of pathologists to carry out a post-mortem of Nebanda's body and in so doing he obtained the samples to be transported to South Africa for an independent analysis.
He was later to be arrested on his way to Entebbe Air Port, detained and prosecuted.
Onzivua says in the suit that as a result of this malicious trial, he incurred unnecessary expenses, humiliation and missed scholarships in Osaka University, conferences in South Africa and consultancy with UNICEF worth 98,539 dollars in Zimbabwe which occasioned him a setback in his career growth.
The case is set to be handled by Justice Elizabeth Musoke who is yet to fix a hearing date.
