{UAH} Effect of the New UNAA Articles on the Law Suit

The Articles of Amendment that were filed today to NOT affect our lawsuit. In our filings, we claim that UNAA had about 2,000 members. Under the old constitution, anyone that paid for the convention was a member. More than 2,000 people paid for the convention in 2010. If 190 members (out of 2,000) voted for the 2010 Constitution, that is NOT two-thirds majority as Mr. Brian Kwesiga and Ms Aisha Ogwang swore today.  190 out of 2,000 is NOT a 2/3!  But Mr Kwesiga and Ms Ogwang will get a chance to prove in court that 190 members represented two-thirds of the members eligible to vote in 2010!!

As I mentioned before, each Respondent has 20 days to respond to the petition.  Both Mr. Tim Gaburungyi and Ms Rebecca Namwase have about 7 days left to send me their answer to our petition.  I will then request the Court to move our case to the business Division where cases move very fast.

Once I get Mr. Gaburungyi's response, the "pre-trial litigation" process will begin.

I will draft requests for documents (interrogatories) that I will send to UNAA.   UNAA will have send me all the documents supporting their position. They will also have to send me documents that do not support their position.  My requests will include Minutes of Board/Council/Executive meetings, financial data, emails, recordings, UNAA's bank statements, lists of members and contact information, etc.

Today, UNAA President Brian Kwesiga and Secretary Aisha Ogwang filed several documents with the Secretary of State for Massachusetts:

1. change of resident agent: today, UNAA has appointed Rosette Serwanga to replace Mr. Moses Bukenya (UNAA dismissed Mr. Bukenya in Aug, 2013 because he had stolen about $25,000. In April 2014, UNAA reappointed Mr Bukenya as its agent in Massachusetts.  In May 2014, UNAA lent Mr. Bukenya about $25,000. In the 2014 tax filings, UNAA informed the IRS that Mr. Bukenya had not yet started paying back the loan. But UNAA added that Mr. Bukenya was not in default on the loan terms. The terms of the loan are unknown).

2. Articles of Amendment: today, UNAA filed Articles of Amendment which will become effective tomorrow (4/8/2015). Both Mr Kwesiga and Ms Ogwang falsely certified and SWORE under penalties of PERJURY that the Articles of Organization (i.e the 2010 Constitution) were duly adopted at a meeting held on 9/5/2010 , by vote of: 190 members vs 0 , being at least two-thirds of its members/directors legally qualified to vote in meetings of the corporation"!!!
