KAMPALA.
Constitutional Court Judge Eldad Mwangusya has this morning declined
to release nine jailed Muslim leaders including the leader of Tabliqs
sect Yunus Kamoga.
Sheikh Kamoga and group are accused of being behind the wave of murder
of top Muslim clerics in the country early this year including the
murder of Sheikh Mustafa Bahiga at Bwebajja along Entebbe Road, and
Sheikh Abdulkadir Muwaya in Mayuge District.
They had asked court to release them on grounds of continued detention
at Luzira prison without trial and also failure by the DPP to avail
the defense team the evidence that they intend to produce at the
trial.
But while declining to release nine sheikhs, justice Mwangusya who was
recently elevated to the Supreme Court, held that in order for the
victims of the murdered clerics to get justice, it's was prudent that
those suspected to be behind are not released.
The judge also observed that despite the delay by the DPP to avail the
defense team with the evidence they intend to use against the
suspects, the same omission will not make the evidence "worthless".
Shortly after the Tabliq leader had been denied temporary freedom, the
Tabliq faithful that had gathered outside the court premises in
hundreds, in protest shouted the Muslim slogans of Allah Akbar.. Allah
Akbar… while punching their fists in the air.
The police blocked the protesting Tabliqs from entering the court
precincts. The protest was however peaceful as there were no incidents
of harming each other or confronting the riot police.
The judge further in his ruling agreed with the prosecution that the
hearing of the main constitutional petition in which the suspects are
challenging their arrest, torture and confiscating of their property
like cars and phones, be fixed and be expeditious heard.
The other suspects are; Siraje Kawooya, Abdulsalaam Sekayanja, Mubiru
Abdulhamid Sematimba, Rashid Jjingo, Twaha Sekitto, Yusuf Kakande,
Murta Mudde Bukenya and Fahad Kalungi.
The group that was being represented in court by Fred Muwema, was
accordingly sent back to Luzira prison as they await the next move.
