{UAH} Petition hearing so far
Mbabazi: Mr Tumusiime says we are wasting time but he delayed to give us those documents.
-- Mbabazi: It is him with the document. It is him arguing on it. Why doesn't he submit it so that court decides on it?"I understand the constraints that you have to deliver judgement within 30 days but we were given these documents today"
Mbabazi: This is a presidential petition, if someone says "these are the results", they should produce those results
Mbabazi: We request for time to make an analysis [of the documents finally submitted by EC] to bring out our case Mbabazi points out that as per submitted documents from EC, they've already singled out inconsistencies.
Mbabazi: We acknowledge receipt of documents from EC and request for time
Kiwanuka: Supreme Court is constrained by time. If court is two say petitioner needs more time, then respondents need time 2 respond"They've not filed any proof that before they filed, they asked for the docs. The notice to inspect was after the amendment"Kiwanuka says it would be "most unfair" if the petitioner is given more time to analyse DR forms
Kiwanuka: Even if you allowed them more time, the court can only inquire into the petition before them.
Kiwanuka: Which paragraph of the petition would these documents help? No paragraph says that DR forms are needed to prove
Rukutana: You don't got to court in anticipation that you will recover material from the opposing side to use in your case
Rukutana: The claimed document is not evidence before court. How do we know it wasn't made yesterday?
Rukutana: No sufficient cause has been shown by the petitioner to compel court to extend time
Tumusiime: The petitioner had every opportunity to put in an affidavit to seek this info beforehand before filing amended
Tumusiime: If the petitioner has no own DR forms, he is abusing the court process and wasting courts time EC lawyer Tumusiime says petitioner could have acquired own DR forms had he fielded agents
Twinobusingye: We have an obligation to be truth. We saw a sea of documents and asked for copies. Then they lied.
Twinobusingye: These are more than 20k docs. Common sense dictates that we need to look at these documents and analyse them.
Twinobusingye: 2nd respondent lied that he had given us the docs. He even apologised. This conduct requires admonishment. -
