{UAH} Supreme Court Orders EC to Avail Declaration Forms
Chief Justice of the Supreme Court, Bart Katureebe has directed the Electoral Commission to immediately avail the declaration forms as demanded by Amama Mbabazi.
During the pre-trial of the petition in which Mbabazi is challenging the declaration of Yoweri Museveni as winner, Justice Katureebe said that the Electoral Commission was going against the law.
Muhamad Mbabazi one of the petitioner's lawyers told court that they require the hard copies of declaration forms signed by district returning officers to compare with soft copies earlier provided to them.The team demanded that the forms be availed before Saturday which the EC lawyers said was impossible.
"The law requires that after tallying of the votes, district returning officers immediately send the forms to Electoral commission headquarters followed by detailed reports within 7 days," said Justice Katureebe.
He added; "Therefore you must ask these district returning officers to with immediate effect send those forms whether in electronic format or hard copy."
Counsel Enos Tumusiime, who represents EC had earlier surprised court saying he wasn't sure which documents were scanned and sent by the district returning officers.
"We provided the petitioner with soft copies of the tally results at district and national level as well as detailed results from all polling stations. However if they need to compare the figures with hard copies, we shall have them ready by 2pm on Saturday," said the EC lawyer.
Tumusiime claimed that the Electoral Commission hadn't gathered all physical tally sheets across the country, adding that they are still busy organizing elections scheduled for Friday.
Chief Justice Katureebe however, insisted that given the time limitations of the petition couldn't accommodate any further delays.
Citing Section 56 of the Presidential Elections Act, the Chief Justice said the EC ought to be in possession of the forms by now. He ordered that EC meets with the petitioner on Saturday for the signed forms to be inspected.
