Mbabazi's former bodyguard surfaced out of the blue, after police had failed to find him. Now the police badly want him, but General Saleh is in control.

Behind the public display of harmony in the aftermath of Christopher Aine's return, police and Gen Salim Saleh are quarreling and jostling for custody of the former head of Amama Mbabazi's campaign security detail, The Observer has learnt.

Aine disappeared last December, triggering a police manhunt and suddenly reappeared last week in the company of Gen Saleh. Sources said that while police wants to question Aine in relation to his past activities, Saleh has thwarted these attempts in preference for mediation.

According to insider sources, the warrant of arrest issued against Aine by Jinja Magistrate's court this week was pushed for by some senior police officials.  Aine is wanted on two charges of assaulting the regional police commander of Kiira, Edgar Nyabongo in Jinja last year.

On December 13, he also allegedly led a group of people who attacked NRM supporters in Ntungamo district. Ever since Aine came out of hiding, police has tried and failed to take a statement from him.

"We have tried all our best to have Aine record a statement but we have failed," a police insider told us.

The insider said Aine needs to record a statement with police regarding where he was, how or whether he went out of the country, how he came back and what he has been doing. Police also wants Aine to reveal the people he has been communicating with when he was in hiding and how he got into Saleh's hands.

"Gen Saleh is fully aware that Aine has been on the police wanted list and we have been looking for him. So, since he surrendered himself to him, he should have also surrendered him to us to record a statement," the insider said.

The source said Saleh is committing another offence, of hiding a wanted person. We have been told that some people in police have suggested that they open up a case against Saleh, if he continues to frustrate their efforts.

"Aine is wanted by the state to answer criminal charges but Gen Saleh is keeping him as the state or an individual?" one senior detective from CIID asked.

Other sources in security told us that the real fight between Saleh and police over Aine is about ego and power. Apparently, some people in police are not impressed that Saleh has stolen the spotlight and is taking the credit for Aine's return.

Saleh has since booked Aine into a heavily- guarded motel in Mutundwe, a Kampala suburb. Sources told us that part of the reason why Saleh has declined to release Aine to police is because he is worried that this could undermine his cooperation with government.

On Wednesday, we reported that he had cut a deal with the government that involves him revealing details of Mbabazi's activities in exchange for protection. Our sources told us that the friction between Saleh and police will not get in the way of this deal. Fred Enanga, the police spokesperson, said yesterday they were waiting on some advice from the attorney general on how to proceed with the matter. 

"The attorney general has not responded to us and we are still waiting for his legal opinion," he said. 

After four months of hiding, Aine resurfaced on April 7 in the company of Saleh and said he had been hiding in Tanzania. While his reappearance put to rest rumours that he had been killed, it raised fresh questions about how he got in touch with Saleh and whether the state will proceed to charge him.

Sources in Mbabazi's camp told us that they all along suspected that Aine was being hidden in a house in Mutundwe. That is why, they said, Mbabazi lodged an application seeking to compel the police to produce Aine dead or alive. He lost the case.
