{UAH} MAILO IS TRADITIONAL AND CUSTOMARY

ON RADIO SAPIENSER TONIGHT
Mailo land tenure both Official Mailo (Kabaka's , Katikkiro's ,
Omulamuzi's , omuwanika's and saza and gombolola estates), private
Mailos, both for individuals and institutions (church missions) have
part and parcel of Uganda since the signing of Uganda Agreement of
1900, and are now part of traditions and customs.
The failure of 1975 Land Reform Decree by the late Idi Amin, in an
attempt to abolish Mailo Land tenure both official and private, is a
clear testimony that it is not an easy potato to eat.
Busuulu and Envujjo law of 1927 which protected customary tenants
(bibanja holders that were found on the land prior to 1900
distribution, and thereafter, those who settled on the land on the
consent of the land owners), 1995 Constitution that restored Freehold
including Mailo, and Customary tenure, and retained land lease, 1998
Land Act and subsequent amendments, are ongoing land reforms.
So Bamugemereirwe Commission is not more strong than Obote, AMin and
others who have attempted to abolish Mailo land but failed.
Even outside Buganda, like in Ankole, Tooro, Busoga and some parts of
Bunyoro and Eastern Uganda, there are a few Mailo estates, and now a
growing number of freeholds that have been converted from leaseholds,
after the promulgation of 1995 Constitution.
Land grabbing and massive evisctions are more on former public land
(Akenda) in Buganda by powerful political and military leaders, than
on private mailo. This is rampant in greater Mubende, Luwero, Masaka,
Mpigi and Mukono.
So, the solution should be to put money in the land fund so that after
a successful experiment in Kibaale, it is extended in the whole of
Buganda and Uganda.
Another successful experiment was in Isingiro, Bukanga, Kashari and
ibanda, where Omugabe of Ankole was paid off and his subjects who were
tilling his Official Mailo were given tittles. A similar arrangement
were done with the Namasole of Tooro. It is more needed in Buganda and
many Mailo land owners and bibanja holders, are willing to make
exchanges so htat the land is not co owned.
