COVID19: KAMPALA TRADERS SUE LANDLORDS OVER RENT, WATER & ELECTRICITY BILLS
Kampala Traders under their umbrella body; KACITA Uganda Limited has sued Landlords over rent, water and electricity bills during the Covid19 Lockdown.
According to the documents seen by our team, the Plaintiff' (Kacita) through their Lawyer M/S Ortus Advocates filed the case against the Defendants (Landlords) on the 4th June 2020 at the Civil Division of the High Court of Uganda under Civil Suit No. 132 of 2020.
Among the Plaintiff's claim against the Defendant is;
1. A declaration that the performance of the obligations of the plaintiff's members (list attached) under the tenancy agreements executed with the defendants were temporarily frustrated by the restrictions imposed under the Public Health (Control of Covid19) (No. 2) Rules, 2020.
2. A declaration that the plaintiff's members are not liable to pay rent for the premises they occupy on the defendants buildings for the period during the lockdown on account of the Defendants having failed to provide the rental space for the premises during the period of the lockdown.
3. A declaration that the Plaintiff's members are not liable to pay utility bills for the premises they occupy on the Defendants building for the lockdown period.
4. An order be issued prohibiting the Defendants from demanding rent for the premises occupied by the Plaintiff's members for the period of the lockdown.
5. An order be issued prohibiting the Defendants from evicting the Plaintiff's members on account of the failure to pay rent during the period of the lockdown.
6. A permanent injunction restraining the Defendants from demanding rent for the period of the lockdown and from evicting the Plaintiff's members for failure to pay rent during the same period
The country has been in lockdown for over 75 days. So far majority of the Kampala Traders have been affected by the lockdown since the arcades, malls, offices where they work from have been closed since the lockdown was effected by the President of Uganda in March 2020.
The traders have been on record calling upon government to come to their rescue and ask Landlords not to demand rent, water, electricity bills from them since they haven't been working.
The President while addressing the nation yesterday in his State of Nation Address said; "Government will not allow the landlords evicting tenants on account of not paying rent and that discussions have started with both groups and a solution will be found."
