Where Kigozi works, they are not allowed to use phones, computers or listen to music until they leave the work premises on Friday morning. So whenever Friday arrives, Kigozi feels like he has been released from Prison and the next Monday always ambushes him. This time, he left and immediately ordered a crate of ice cold beers so that he would enjoy the 'Dance Party"on TV with his friends. As usual, the weekend was a blur, and he was surprised when police officers showed up at his work place on Monday morning to arrest him for kicking his neighbour on Saturday. The trouble is, he just cannot remember any of what they are saying. Can he use this as a lawful excuse to avoid the long arm of the law?
WHAT DOES THE LAW SAY?
When a crime is committed, the law allows a person to use certain "excuses" (called defenses) for why they should not be punished for that crime. The one that involve you not remembering or knowing what you are doing is intoxication.
Intoxication is the condition of having physical or mental control reduced by the effects of alcohol or drugs. By law, a person cannot be punished for a criminal act if when he/she committed the crime, he/she was intoxicated and it made him/her incapable of understanding what he or she was doing or that it was wrong. For example, if Kigozi indeed kicked his neighbour but did not know what he was doing or that it was wrong, because he was intoxicated, then the law cannot hold him responsible for this. However, if this intoxication was caused by his own act, such as when he drinks a crate of ice-cold beers or willingly takes drugs, then he cannot rely on this to say he did not know what he was doing.
