America First Legal Takes On Maricopa County: Are Illegal Votes Swaying Elections?
In a move that underscores the ongoing battle over voter integrity, America First Legal (AFL) has initiated legal proceedings against Maricopa County, Arizona.
The lawsuit alleges that the county has failed to adhere to state laws mandating the removal of noncitizens from voter rolls. AFL, a Washington, D.C.-based organization, is spearheaded by Stephen Miller, a senior advisor from the Trump administration.
The lawsuit was filed against Stephen Richer, the Maricopa County Recorder, as reported by the Daily Caller. This legal action follows the refusal of Richer's office to comply with AFL's demands to purge foreign nationals from the county's voter rolls.
"America First Legal is leading the charge to keep illegal aliens from voting in 2024," Miller stated. He further accused Maricopa County of "refusing to remove illegal alien voters from the rolls," in what he described as a "direct violation of state law." Miller emphasized the gravity of the situation, stating, "We are taking decisive action: suing Maricopa County for unlawfully permitting illegal aliens and foreign citizens to interfere in the 2024 election."
This lawsuit is the latest development in AFL's ongoing efforts to ensure voter integrity in Arizona. Last month, the organization sent demand letters to all fifteen counties in the state. These letters urged county election officials to comply with state laws prohibiting noncitizens from voting and threatened legal action if these laws were not upheld.
In response to these demands, Richer, through his attorney, claimed that his office was already verifying voter citizenship. However, AFL disputes this claim, asserting that the number of registered voters in Maricopa County without confirmed citizenship "continues to rise."
According to a press release from AFL, as of April 1, over 35,000 registered voters in Arizona had failed to provide proof of citizenship, rendering them ineligible to vote in state and local elections. This figure is particularly significant given that the 2020 Arizona presidential election was decided by a margin of less than 11,000 votes.
Arizona law stipulates that proof of citizenship is required to register to vote. However, a Supreme Court ruling determined that state governments cannot impose additional voter registration requirements beyond those already required by federal registration forms. This means that Arizonans who fail to provide proof of citizenship can vote in federal elections, but not in state or local ones.
AFL's lawsuit alleges that Richer is failing to fulfill his legal obligation to perform monthly voter roll maintenance to confirm the citizenship of federal-only registered voters. "How can Arizonans have confidence in the integrity of their State’s elections when the government officials in charge of administering that election are not even following the law?" questioned James Rogers, AFL legal senior counsel.
Rogers further expressed concern about the potential impact of noncitizens on election outcomes, stating, "This lawsuit is about helping to restore the public’s trust by making sure that election officials follow the law and that foreigners are not able to influence the outcome of our elections."
The issue of noncitizen participation in U.S. elections has become a contentious point of debate between Republicans and Democrats. President Joe Biden publicly opposed legislation aimed at strengthening election integrity in July, specifically Texas GOP Rep. Chip Roy’s Safeguard American Voter Eligibility Act.
The AFL lawsuit is filed on behalf of the Strong Communities Foundation of Arizona and Yvonne Cahill, a naturalized citizen and registered voter.
