Undocumented migrant accused of sexual battery of 5-year-old while working at her PBC home

PALM BEACH COUNTY, Fla. (CBS12) — An undocumented 25-year-old migrant from Guatemala is accused of inappropriately touching a 5-year-old girl on two separate occasions.

The Palm Beach County Sheriff's Office (PBSO) said the 5-year-old victim was interviewed by the Department of Children and Families (DCF) on December 13, 2024.

According to the heavily redacted arrest affidavit, DCF had to first check if the young girl was capable of distinguishing the difference between telling a truth and a lie. Once it was established that the young victim would only tell the truth, the child was asked if anyone had inappropriately touched her, the question brought the girl to tears and she began shaking.

The girl told investigators that she was touched twice — once in the garage and another time in the bathroom — by someone who worked at her home, identified as Nicolas Jose Francisco.

The victim continued saying in the first instance, she was called to the garage by Francisco and she recounted in detail in the interview how she was sexually battered. She told police that he "touched her flower," what she called her private area.

In the second instance, the victim told investigators she was taken to the bathroom where Francisco allegedly exposed himself to her and touched her again. The girl recounted that she was scared and that she would not make drawings for him again.

On January 2, PBSO interviewed Francisco who said he had touched the girl by mistake in both instances and the victim's family was making an accusation because he was an undocumented immigrant from Guatemala.

Based on the interviews collected in the case, Francisco was arrested and booked on two counts of sexual battery on a victim under the age of 12 years old.
