A Ugandan businessman on Friday denied falsely receiving $200,000 (Sh16.9 million) creditfrom a Nairobi company in a Makadara court.

The trial magistrate Tom Okelo disqualified himself from hearing the case. Okelo said the complainant had made application for him to disqualified from the case because he was handling another one against the same accused person Michael Mulyoowa.

Mulyoowa now faces new charges that between June and October 2009 at Industrial area, Nairobi he obtained $200,000 credit from SMR Limited which he has not paid.

He is also accused of issuing a bad cheque for $200,000 in favour of SMR Ltd on October 20, 2009 knowing that his account had inefficient funds.

Trial magistrate Emily Nyongesa ordered for him to be remanded to enable her go through his previous records before granting him bond.

On May 21, the complainant in the case, through lawyer Adala Odhiambo applied for Okelo to disqualify himself from the case.

In a letter, Odhiambo said he has been instructed by the Mulyoowa to inform the court that it may not receive full justice as required by the law and the constitution if the case proceeded for hearing in the same court.

He said the complainant's reservations and apprehensions as to possible denial of justice is based on the grounds which will be elaborately expounded by counsel on leave being granted for the purposes.

However, Okelo disqualified himself, saying that although no sufficient evidence has been adduced to warrant his disqualification, he deems it fit to transfer the case to another magistrate so that justice is done.
