Army Captain drags Stanchart to Court, claims Crafty Bank Employees captured his ATM Card and Siphoned several Millions off his Account

A UPDF Captain is ranting after Standard Chartered Bank employees reportedly captured his ATM card and helped themselves to several millions from his account.

Damsan Christmas has moved to court, seeking more than Shs200m in alleged lost millions and compensation.

City lawyers Akampumuza and Company Advocates filed the soldier’s case at the Commercial Section of the High Court seeking justice.

Christmas says he learnt of the scam when he turned up at Stanchart’s Nakumatt branch on October 1, 2012. When he inserted the ATM card in the teller machine, Christmas claims, the gadget was simply captured, before he got info that he could not withdraw money.

‘I immediately reported to the bank, but nothing was done. I wanted to use money in my transport business as well as draw my 700,000 UPDF salary,’ Christmas mourns.

From that point in time, Christmas argues, he could not access his bank account and has remained as such to this day.

Subsequent reports to the bank, Christmas claims bore no positive results till his lawyers finally wrote to the bank on December 2012, when management promised to investigate the matter as they had done before, but still backtracked.

This is why he has now resorted to the courts of law to claim what he alleges is his stolen money.

However, the bank scoffs at the allegations. Represented by Byenkya, Kihika and Company Advocates, the bank suggests that either Christmas withdrew the money himself, exposed his ATM to third parties or even had no money on his account as he claims.

For suggesting he stole his own money, Christmas sues the bank for defamation for implying he is a fraudster. He argues that the story is made up by the bank in order to escape liability for failure to keep his money safely.

The matter was initially submitted to mediation for the parties to sort it out. But the mediator referred it back to court for full litigation after the bank lawyers skipped the process.

Justice David Wangusti has appointed November 28, 2013 to carry out the scheduling conference where the parties will point out the issues that they want court to resolve.
