{UAH} Attention Haji Katerregga: NJUBA MURDER BOMBSHELL INQUIRY

It was publicly announced in the Ugandan media that Museveni and his wife Janet Museveni took or planned to take a public HIV/AIDS test. This was a few weeks ago, but there has been no further reports on whether the tests were conducted or not. Nor was the public given an explanation for conducting such a test in public. In the circumstances, we can only surmise that either Museveni or Janet suspected the other of infecting him/her with the deadly virus, which,  barring any other reasonable explanation, could only  have been passed on by having an adulterous sexual relations with another person or animal.

Several hours ago, it was printed in the Ugandan media that Mr Sam Njuba, a one-time Attorney General and chairman of the opposition FDC party, died in hospital in circumstances that are not wholly clear at the moment, and for confidentiality reasons., are being kept private by the family.

But, in light of the public revelation by Museveni that he could possibly be a carrier of the HIV virus passed on to him by Janet Museveni or another man. woman or animal, and given Museveni's well known adulterous relationship with Mrs Getrude Njuba, the widow of the late Sam Njuba, many Ugandans are concerned that Mr Njuba's death may not be as untoward and clear-cut  as it may seem. They have therefore asked me to express an opinion on the matter, especially if a chain of causation in the passage of the HIV virus from Museveni via Mrs Njuba to Mr Njuba himself can be established, and if so, if there is any criminal culpability in law.

Knowingly or recklessly infecting another with the HIV virus is now accepted in law to constitute both the  intent (mens rea) and the act (actus rea)  elements of either the crime of murder or causing grievious bodily harm. This much is now accepted in English law. 

So did Museveni murder Sam Njuba or recklessly cause his death? 

This question is only relevant if Mr Sam Njuba died as a result of complications arising from AIDS. This has not yet been revealed to be the case and would form the central piece of any investigation. But in determining criminal culpability, what would be paramount  would be the following causasive events:

1. Whether Yoweri Kaguta Museveni had the HIV virus in his body at the time he had carnal knowledge of  or sexual intercourse with  Mrs Getrude Njuba; If so
2. Whether Yoweri Kaguta Museveni knowingly or recklessly passed on this Virus to Mrs Getrude Njuba,
 knowing or suspecting that she too would in turn pass it on to Mr Sam Njuba? 
3. In the alternative, whether Mr Yoweri Kaguta Museveni conspired with or forced, coerced, colluded with or decieved  Mrs Getrude Njuba to infect Mr Sam Njuba with the HIV virus
4, Whether knowingly or recklessly,Getrude Njuba infected Mr Sam Njuba with the same strain of HIV virus passed on to her by Mr Yoweri Kaguta Museveni.
5. Whether as a result of being infected by  HIV by Mrs Getrude Njuba, Mr Sam Njuba died of an AIDs related illnesses and that such AIDS condition was caused the HIV Virus contracted from Mrs Getrude Njuba, who in turn was infected by the same strain of HIV virus by said  Yoweri Kaguta Museveni. 

Therefore to attract any criminal culpability on the part of Mr Yoweri Kaguta  Museveni, one would have to establish that he was a carrier of the HIV virus at the point at which he had sexual intercourse with Mrs Njuba, that this sex was consensual and no rape or deception or coercion was used by Museveni, and that Mrs Getrude Njuba then went on to infect Mr Sam Njuba knowingly or recklessly ie having unprotected sex with him  without paying due attention to or caring about his safety and well-being.

These are matters that require further investigation in my opinion, but would require the cooperation of all the parties involved, particularly Mrs  Getrude Njuba and Mr Njuba's own family. As a possible co-conspirator, Mrs Getrude Njuba may understandably not want to cooperate.

This would be the second case of possible murder  I am investigating  against Yoweri Kaguta Museveni. The first one is of the  mysterious disappearance of his own wife, Hope in Dar es Salaam, Tanzania. Hope disappeared without trace in 1976-1977. Museveni was the last person to see her alive and  is the only suspect in the investigation. I must say Hope's family have not been very cooperative with my numerous attempts to bring a private criminal prosecution for the murder, abduction or kidnapping of their daughter by a man who I now know is a serial murderer. 

It would therefore in the public to have all the circumstances sorrounding Njuba's unfortunate death to be cleared up before he is interred  so that conspiracy theories do not emerge as they have unfortunately done in all such cases, as in the equally mysterious death of the MP Nabanda.
