{UAH} High Court Judge Yasin Nyanzi has refused to leave the Lukwago case
High Court Judge Yasin Nyanzi has refused to leave the Lukwago case calling the Attorney General’s (AG) complaint of bias leveled against him, mere allegations.
Nyanzi lashed out at the Attorney General Peter Nyombi saying his conduct is embarrassing and not expected of the AG.
The AG filed an application asking Justice Nyanzi to disqualify himself from handling the matter any further saying he is biased. The proceedings in which the AG made the application were held in camera at the Judge's chambers at the High Court.
His application came after on November 28, 2013 Justice Nyanzi granted Erias Lukwago a temporary injunction against Kampala Capital City authority (KCCA).
Nyanzi said in his ruling that he was convinced by Lukwago’s lawyers that their application for judicial review had good chances of succeeding in Court. Lukwago through his lawyers applied for a judicial review of the proceedings and findings of the tribunal that recommended his removal from office.
Giving his reasons for granting the injunction, the judge said that Lukwago has a status quo to protect as Lord Mayor and that his main application for judicial review raises serious triable issues which have a probability to succeed.
However, while Lukwago’s lawyers secured the order and served it on the Council during the impeachment session, the Attorney General insisted that he was never served and that he was the right person to be served.
