{UAH} Otafiire: Gov't to Blame For Inefficient Judiciary



Justice and Constitutional Affairs Minister, Gen Kahinda Otafiire, has placed the Judiciary's current underperformance on too much intervention in its activities by the executive.

While the three arms of government are meant to complement each other and together form the broader body of government, Otafiire said that the uncontrolled interference and manipulation of the Judiciary and parliament by the executive continued to render the two ineffective. "If all was well and fair, there wouldn't be the need for the principle of separation of powers," said the General at a Uganda Law Society Function in Kampala today. Otafiire described the 'endangered' Judiciary as the most sensitive arm of government that still holds the population together in peace. "The citizens ought to have confidence in parliament and the executive, but when issues arise from the two arms, there must be recourse to the Judiciary." He added: "The Judiciary is the last line of defence and only through it can peace and harmony be seen. It's when the population loses hope in the Judiciary that they take matters in their hands, and once that happens, hope is lost and chaos ensues." Otafiire also hinted on government's failure to improve the lives of the Judicial officers as a major cause of the sector's poor performance. "As the head of this department, I would like to see the quality lives of our judges and law officers enhanced, because I know that excessive human need often plays havoc with human nature."
