Kenya: Fresh Claims Arise in Joho's Degree Saga
BY SAM KIPLAGAT, 2 JUNE 2014 A law firm in Uganda has been accused of forging a court order in the case involving the degree of Mombasa Governor Hassan Joho.
In new proceedings filed before the Constitutional Court in Uganda, the law firm is accused of including a fabricated order barring the police from investigating the degree awarded by Kampala University to Joho. However, the university never sought such an order when they appeared at the Uganda Court of Appeal.
The university only sought three orders when they appeared before SBK Kakuma on April 22. Justice Kakuma then granted interim orders stopping the proceedings at the High Court but directed the registrar to expedite the hearing of the case.
He said costs would be awarded according to the outcome of the case. However, Katuntu & Co Advocates allegedly included an order not sought before the court. The order was served upon the police and other parties barring any investigations into Joho's degree saga.
Another order allegedly ordered parties to maintain the status quo. Eight days later, the National Council for Higher Education unanimously resolved not to recognise the degree awarded to Joho. The university then moved to the High Court and successfully obtained orders staying the proceedings.
The former chairman of Kenyan Students to Uganda, Silas Otuke, has been driving the case against Joho in Uganda. In his affidavit, Otuke claims that the judge did not order the status quo to be maintained or stop the police from investigating.
On May 19, Otuke, the director of an NGO called Youth Leadership, Governance and Guidance, wrote to the Ugandan CID about the alleged forgery. "Please note that the said aspects of the forged order have been used to halt government agencies and departments from pursuing any further action in regard to the impugned degree of Hassan Ali," the letter reads.
