{UAH} Response to Pastor Musoke: Petition to Remove Unlawfyl Positions

1. When I run for president, I did not know that the constitution was illegal in Massachusetts because I had not read the relevant law. I knew it would be illegal in California, Delaware, NY, Texas and Oklahoma, etc and I mentioned that issue on unaanet but several people that drafted the constitution responded that I was wrong.  Tim Gaburungyi even pointed out that they had sent the draft constitution to their legal adviser (Mubiru Musoke?) and he had approved it. At that time, I'd no reason to question his advice.

2. I demanded for reinstating the Treasurer because his position was not created under the illegal 2010 constitution. The Council positions were newly created under the 2010 constitution.

However, the better questions should have been:

a. how did we pass and function under an illegal constitution?

b. now that we know that the constitution is illegal, how can we fix that?

c. are there any members that would want UNAA to act outside the state law?

Of course I am assuming most members would want UNAA to act within the relevant state law.

Joseph, why did you run for president under a constitution you knew was illegal? And why should I demand for the reinstating of a treasurer elected by the people then at the same time demand for the dissolution of a council which itself was elected by the people?

                                              Petition to Remove Unlawful Positions

The undersigned members representing more than 10% of the members of Uganda North American Association, Inc.  hereby demand that within 15 days of the date of this petition:

i-the Executive dismiss the Director of Communication, Director of Finance, Director of Development;
ii-the Executive disband the entire Council, the Board of Trustees and the Election Commission;
iii-the Executive declare that the Election Commission shall be composed of members appointed by their respective local chapters;
iv-Timothy Gaburungyi shall cease controlling the website and mailing list of the association;
v-Jude Sempungu shall assume all powers of the treasurer, including full custody of all funds of the association and compiling the voters' register and members' register.

REASONS for removing the unelected Directors, the Council, Board of Trustees and Election Commission: the Directorships,

Council, Board of Trustees and Election Commission were created under the 2010 constitution which is unlawful. The 2010 constitution was not passed after the statutory notice period (M.G.L. Chapter 180, s. 17); the statutory requirement for a 2/3 majority vote was not met (M.G.L. Chapter 180, s.7) and a petition was not sent to the state to explain why that requirement was not met (M.G.L. Chapter 180, s.7A); the state has not approved the 2010 constitution (M.G.L. Chapter 180, s. 17); and the 2010 constitution has several illegal provisions like not allowing members a vote to approve Board members (M.G.L. Chapter 180, s. 17), not allowing members to nominate candidates for the Board of Trustees (M.G.L. Chapter 180, s. 17) and Article 3.6 of UNAA's constitution allows the Council (management) to expel members without a general membership vote (M.G.L. Chapter 180, s. 18),etc.

REASONS for removing Timothy Gaburungyi from the association's website and mailing list are that he has blocked several members from the list without explanation and because this is an election year, Timothy Gaburungyi has been blocking messages that are unfavorable to the current Executives. 

REASONS for restoring the treasurer's powers and duties is that Jude was directly elected by voters. The power to remove remains with the voters.
