{UAH} Mr Nekyon: Cord files case to stop implementation of security laws

CORD through its lawyer James Aggrey Orengo is trying to benefit from its own chaos. Look at the grounds. 
 
 
 
 
 
"Mr Orengo also argued that the new laws violate the right to fair trial and being presumed innocent until proven guilty. He said offences created under the act are oppressive and unjustifiable."
 
I have not looked at the law but I suspect it does what the Patriot Act did which was to amend sections of the  Evidence Act. Remember it  was an omnibus bill which amended several laws.
 
 
 
"The lawyer told the court that the Bill was passed unconstitutionally as it involves matters touching counties and Senate was not involved".
 
"He further alleged that the public were not given a chance to air their views on the Bill claiming that it was taken to Parliament a day after it was drafted".
 
He is lying. Kenyan were invited to air their concerns at county hall where well meaning Kenyans. not CORD mobs gave their views and suggestions to improve the law and make it constitutional.   After public input, amendments  were incorporated, see this link

It was mostly CORD MPs standing, pouring water on speaker and tearing order paper. CORD cannot purport to benefits from its won actions. There is legal term for that. You cannot do something and then turn around and use  it as your shield to try and defeat  justice.  If MPs were standing, CORD must carry its own cross for its stupidity.  Apparently the strategy was to make CORD MPs stand and hope the law would not pass. Unfortunately, for CORD, its own MPs are responsible for the condition they are now listing as a ground.  Good to see the judge declined to issue their ex parte orders.
 
To be blunt CORD's strategy was puzzling.  You decide if the won any converts. To add insult to injury TNA is going to pick up the Kajiado central set being vacated by the incoming interior SC.
 
BTW, CORD board/NEC has picked Kajwang's  brother to contest Homa bay, even though surveys placed Mr. Okundi top.   Again you decide whether that is democracy.  Why not let the voters of Homa Bay pick their candidate through primaries?
