Draft law colonial, says Ghai - Politics
The proposed changes to security laws are a threat to the Constitution, law scholar Yash Pal Ghai has said.
The Security (Amendment) Bill, which was drafted by the Parliamentary Committee on Administration and National Security, has proposed radical changes in tackling insecurity.
However, Prof Ghai said some provisions in the Bill seek to restore "the colonial framework in managing security where the police are there to beat people instead of protecting them".
The right to a fair legal process will be removed if police are authorised to detain suspects for long periods and charge people merely on suspicion, he added.
Prof Ghai, is a former chairman of the Constitution of Kenya Review Commission, which prepared the Bomas draft that contributed to the current Constitution.
Some of the proposals may take away the roles of Parliament and Judiciary as provided for in the Constitution, he added.
He was speaking at the University of Nairobi Thursday during the launch of a book, Kenya: The Struggle for a New Constitutional Order.
