{UAH} Presidential advisor sued for sh350m over facebook comments

Presidential advisor in charge of poverty alleviation in Busoga, Maureen Waluube Kyalya has been sued by a city lawyer for sh350m over purported defamatory facebook comments.
On March 9, Musa Ssekaana filed a civil suit at the civil division of the High Court in Kampala, through two firms Ssekaana Associated Advocates and Kabega, Bogezi, and Bukenya Advocates.
The lawyer alleges that last month, Kyalya made unbecoming comments on the social networking site's group page 'Ugandans at Heart-Community', with ridiculous claims that he had forged a consent judgment.
The consent was for withdrawal of an election petition Kyalya filed after the February 2011 national polls against the victor in the Jinja Woman MP Agnes Nabirye.
Kyalya stood on the Forum for Democratic Change party ticket, but has since defected to NRM
"The plaintiff's reputation has been lowered in the estimation of right thinking members of society who now regard him a criminal, corrupt and unethical who should be shunned by right-thinking members of the society generally," the plaint states in part.
Ssekaana laments that the comments have dented his image of international repute as a legal author, international consultant, lecturer at several higher institutions, a father, practicing Muslim(Hajj) and sportsman.
He asserts that Kyalya's claims, also published in the tri-weekly, The Observer are unfounded, since she was present at the Court of Appeal when the consent was endorsed.
"The plaintiff further contends that the defendant for the time she has been Presidential Advisor on Poverty Alleviation did not deny her signature on the said consent but upon being sacked, she is making an excuse belatedly," Ssekaana states.
He accuses Kyalya of a revenge mission after he purportedly declined to change the wording on the consent judgment to the effect that the Electoral Commission should meet her costs.
The endorsed consent stated that each party had to bear its costs at the Appellate Court and the subordinate courts.
Court has ordered Kyalya to file her defense within 15 days from the date of receipt. In the summons dated March 10, 2015, signed by the court registrar Festo Nsenga, Kyalya has been cautioned to heed lest judgement is passed without her input.
When New Vision sought a comment from her lawyer David Owona Balmoi, he said he had been notified on intention to sue.
"We received a letter of his intention to sue a few days ago. If he has gone to court, he is(procedurally expected) to serve us the summons," Balmoi said.
