Prosecution claims killer was paid Shs 30m for the dirty job

Seven months after wealthy businessman Eriya Bugembe Sebunya aka Kasiwukira was murdered while jogging outside his house in a Kampala suburb, three suspects have been committed to the High court for trial. 

While it came to light earlier on that the key suspect was his widow, what is more shocking is the revelation by prosecution that witchcraft was the motive. 

Besides the widow, Sarah Nabikolo, the other suspects are her sister Sandra Nakungu, 34, and Ashraf Jaden, 38, a police officer attached to Muyenga community police station. Prosecution alleges that the trio and others still at large on October 17, 2014 at Muyenga Diplomate Zone, murdered Kasiwukira. 

Kasiwukira was knocked dead by a speeding car during his morning run near his home in Muyenga, an affluent Kampala suburb. Last month, Makindye Grade One magistrate George William Watyekere threatened to dismiss the case if the police failed to conclude its investigations.

When the case came up again yesterday, state attorney Beatrice Adongo told the magistrate that the accused should be committed to the High court for trial because investigations were complete.

Adongo then produced the indictment prepared by senior state attorney Jane Kajuga Okuo.

That on the morning of 17th October 2014 at about 6:30 am police officers stationed at Kabalagala police station received a report that a person had been knocked down by a vehicle at Diplomate Zone, Muyenga that very morning. They rushed to the scene, and found that other police officers from VIPPU who had been moving on a police vehicle pickup No. UP 07680 had already arrived and were managing the scene. 

They found a body lying face-down in a pool of blood in the road. The deceased was identified as Eriya Sebunya Kasiwukira, a resident of the area. The police observed cuts and bruises on various parts of the body.

That the body was transported to Mulago Hospital mortuary, where a postmortem examination was carried out on the very same day. The cause of death was established to be multiple crash injuries and a postmortem report was issued by a pathologist. The police also drew a sketch plan and established that there were no tyre marks, skid marks or even broken glass at the scene.

The immediate information received from some eyewitnesses was that the deceased was knocked down by a vehicle, which had earlier been seen parked at the side of the road. That when the deceased came onto the road jogging as was his routine, the said car slowly drove towards him then accelerated and knocked him down.

It then proceeded towards Kabalagala unstopped. The car was not followed by anyone. The number plate was never identified. The eyewitnesses shall testify in court regarding what they saw.

That initial investigations conducted within the deceased's family showed that the deceased and his first wife Nabikolo Sarah  were having problems in their marriage on account of suspicion of his involvement in supernatural powers locally referred to as "Mayembe," which were disorganizing the home. The wife blamed him for having brought the "Mayembe" and had, with the help of Nakungu Sandra been seen seeking various solutions to the problem.   

The bad relationship was reported to have started the meetings and the plot to kill [him]. That several options for killing the deceased were identified. One option was to grab and kill the deceased while he was jogging in the morning.

They were informed that it was his routine to wake up early every morning at about 5.00am and jog around Muyenga. That this plot was not carried out as the former "Amuka" boy was arrested and taken to prison. This evidence will be adduced in court by the prosecution. 

That when this plan failed, Jaden Ashraf after the month of June 2014 contacted another longtime friend of his (a soldier) by phone to meet him. The meeting took place in Namuwongo where he informed him that he had a deal for him.

He stated that he had two lady friends who wanted someone to kill the husband of one of them. He claimed they were sisters. He disclosed the name of the person to be killed as Kasiwukira, who was a prominent businessman who started out by selling music recorded on tapes.

He also informed him that the sisters wanted him killed because he had brought "Mayembe" which were now demanding a blood sacrifice of either the wife or children of the elder wife who stayed in Muyenga. Whereas he promised to help him, the longtime friend instead reported the matter to his superiors.

That Jaden arranged a meeting between the longtime friend and a lady whom he introduced as Sandra. She confirmed what they had discussed with Jaden and said that her sister, the wife of the rich man, was ready to pay 20 million to him if he killed Kasiwukira.

The meeting happened in broad daylight and he was able to see her clearly. He met her again more than once to discuss the strategy and mode of payment and she was driving her car, a Toyota Harrier.

The plot to kill delayed because he insisted on a deposit and they stated that they were looking for the money. All through this, the longtime friend kept briefing his superiors who were making plans to arrest the parties upon payment. 

A few weeks later, the longtime friend heard of the killing of Kasiwukira through television. He discussed with his superiors who immediately asked him to arrange to meet PC Jaden Ashraf and establish what could have happened.

The meeting happened a few days after the death of Kasiwukira in a vehicle. Jaden, in the conversation with his friend, confirmed that the wife of Kasiwukira had been behind the killing, the person they had used was "too much" of a mafia and that he had been promised 30 million shillings for it. Also that he was expecting his (Jaden) share to be paid soon. He promised to pay him some money out of the payment he received.   

The conversation between PC Jaden Ashraf and his longtime friend was recorded on tape. This evidence will be adduced in court by prosecution. That all the accused were connected to the murder by the assembled evidence.

That they had developed a plan to kill the deceased and went ahead to execute the unlawful purpose, finally succeeding on October 17 2014.

That Jaden Ashraf was arrested and confirmed having approached both his neighbor (the former Amuka boy) and the longtime friend (soldier) officer who was a longtime friend to meet Sandra who wanted them to kill a person. All the accused were examined on PF [Police Form] 24 and found to be of sound mind.
