Legislators said Mr John Bosco Muwonge of Boost Investments should be held until he produces documents that authorised him to demolish the school
Parliament.
Lawmakers investigating the take-over of land belonging to public schools, yesterday ordered police to detain Mr John Bosco Muwonge, the businessman who demolished Nabagereka Primary School early this year.
Mr Muwonge, who owns Boost Investments, and his lawyers were appearing before the House select committee investigating land deals in Kampala. He failed to prove that a court order was issued before the demolition of the school.
"We have asked our CIID to detain Mr Muwonge until he produces the documents he relied on to invite police to demolish the school," Mr Wilfred Niwagaba, the committee lead counsel, said.
Speaking on behalf of Mr Muwonge, Mr Joseph Anguria from Anguria, Aogon and Company Advocates, said: "My client entered into dialogue with KCCA and by choice agreed to leave the promises as per the letter written by Musisi. The permission was given to us by Jennifer Musisi (city executive director) to erect the wall and it's surprising that when she appeared here, she claimed she was not aware."
The Committee chairperson, Mr Robert Migadde (Buvuma Islands), asked: "Did you invite police to witness the demolition?" to which Mr Muwonge said: "Everything was done in accordance with the law and it was done the way it was done and there was no resistance."
However, after Mr Muwonge failed to explain whether he had a court order, Mr Wilfred Niwagaba (Ndorwa West), proposed that he be handed over to CIID for perjury. Mr Muwonge could not say whether he took the purported court order to police before demolition or not and didn't know who applied for the court order in question.
Mr Muwonge kept saying, in Luganda, that all the documents were there including the court order and that KCCA knew about everything and they were in agreement.
Mr Muwonge told the committee that he applied through Uganda Land Commission and was given a title before Buganda Kingdom authorities claimed ownership of the same land on which the school was located.
Meanwhile, Dr Ssali Tamale of the Women Fertility Hospital was kicked out of the committee meeting after he failed to produce documents relating to the acquisition of land measuring five acres belonging to Kitante Primary School.
Dr Ssali told MPs that President Museveni gave him the land after visiting his facility.
