{UAH} History: Spoils of war. Lord Munster said UK got Lost Counties as spoils of war then they became UKs crown Land hence donating them to Buganda.

Dear All

According to the 1961 Lord Munster commission report Britain acquired Bunyoro-Kitara's Lost counties as spoils of war and transformed them into UK's Crown Land.thus becoming entitled to use them as a gift she donated to Buganda to thank them for assisting UK to colonise Uganda.

However, research shows that According to US Title 50 War and National Defence, Chapter 39,, "Spoils of war means enemy movable properties lawfully captured, seized, confiscated, or found".

Emphasis is put on,...movable property....

Land and or counties are not movable property. so these cannot qualify as spoils of war. The Lost Counties cannot qualify as spoils of war.
Indeed, after World War Two, the allied powers, USA, Soviet Union, France, Britain, did not share German land amongst themselves as spoils of war.

And the properties which were looted and acquired as spoils of war and taken by the German Nazis have been restituted back to their original counties.

there is what they are calling , Compensatory restitition, that is returning properties looted by the NAZIs which are now being returned to European countries which had been defeated by the Nazis who acquired properties like  museums, artfacts, castles, treasures, statues, etc

Hence, even if by mistake the Lost Counties were regarded as spoils of war and acquired by UK as Crown Land, time is long overdue for their restitution..with compensation.

Ibingira, in his book, THE FORGING OF AN AFRICAN NATION, argues that The Munster Commission treated this issue as a political one because had the Commission treated it like a legal one,the British Government would have found themselves in a position of having no option but to return all the seven counties to Bunyoro-Kitara.
