{UAH} UPDATE ON LITIGATION...FINAL DOCUMENTS

On July 8th and 9th, I sent to 2 motions to UNAA leaders. One motion was amending the Petition to add names.  The other motion was asking the court to a FINAL ruling based on the documents the parties have filed so far. Under the rules, UNAA leaders had 10 days to send me their responses.  Because I sent the motions via mail, the Respondents got 3 more days to get them....and 3 more days if they send their response by mail....for a total of 16 days to respond. Then I would put all documents together and send them to the court within 10 days. The deadline for UNAA leaders to respond passed last week and I did not get any response from them.  Under the rules, I am supposed to swear an affidavit saying that I followed the rules but they did  not respond in time. Below is the affidavit that I swore:

                                                        AFFIDAVIT OF SERVICE

I, Joseph Musoke, counsel for Petitioners, do hereby swear that:

1.      On July 8, 2015, I served a copy of the Petitioners' Motion to Amend the Petition and a Proposed Amended and Verified Petition for Authority to Call a Special Meeting of Uganda North American Association, Inc. on the respondents by mailing them to Galen Hair, Esq, attorney of record for the Respondents.  A copy of the USPS tracking report is attached to this affidavit as Ex. 1.  

2.      On July 9, 2015, I served a copy of the Petitioners' Motion for Judgment on the Pleadings on the respondents by mailing them to Galen Hair, Esq, attorney of record for the Respondents.  A copy of the USPS tracking report is attached to this affidavit as Ex. 2.  

3.      On July 9, 2015, I sent copies of the above motions to Mr Galen Hair by email. A copy of the email is attached as Ex 3.  On July 17, 2015, I sent the above documents via email to Mr Galen Hair (with a cc to Mr. Arthur Deguglielmo, Clerk to Sup Court).  A copy of the email is attached to this affidavit as Ex 4.

4.      On July 20, 2015, I talked to Mr Galen Hair and he told me that he would send me his response by July 29, 2015.  On July 29, 2015, I sent a reminder to Mr Hair but I have not yet received the responses to the motions.  A copy of my July 29 email is attached to this affidavit as Ex 5.

5.      On August 4, 2015, I notified the Respondents of the filing of the Rule 9A package by serving a copy of the Certificate of Notice of Filing on their attorney of record, Galen Hair via USPS certified mail.
