The Conservative Party of Uganda has taken yet another step to sue The Government Of Uganda in The Constitutional Court over The Presidential Elections Act and The Parliamentary Elections Act.
With reference to Petition No. 31 of 2015 we have taken The Attorney General Of Government and The Chairman Of Electoral Commission to Court under Articles; 1,2,20 and 137(3)(a) of The Constitution Of The Republic Of Uganda.
We are dissatisfied with Section 10(6b) of The Presidential Elections Act and Section 11(c3) of The Parliamentary Act as amended stating that The Nomination Fees for Presidential Candidates shall be Shs 20,000,000 and The Nomination Fees for Parliamentary Candidates shall be Shs 3000,000.
This is a violation of The Constitution of this Great Nation under Articles;1,2,3 and 4 which states that, "the Sovereignty of the people shall be exercised by choosing a leader of their choice through Free and Fair Election". This Constitutional Right can nolonger be exercised because The new Presidential and Parliamentary Acts prohibit many would-be great leaders from coming forward to be nominated and possibly elected.
WHEREFORE, it is requested that the Honorable Court grant the declaration of The Presidential Elections Act 14 of 2015 and The Parliamentary Elections Act 15 of 2015 and Act as unconstitutional having been passed by The Parliament in violation of Articles; 91(1) and 94(1) of The Constitution Of The Republic Of Uganda.
