Court summons prophet Kakande, Gen Mbadi over forest land
Written by URNMasaka High Court Registrar has summoned UPDF Joint Chief of Staff, Major General Samuel Mbadi and Prophet Samuel Kakande of The Synagogue Church of all Nations for obtaining land in Mujuzi forest reserve.
The two are accused of having connived and fraudlently obtained and transacted part of the Mujuzi forest reserve - demarcated government land between themselves.
Court presided over by the Masaka High Court Registrar, Julio Asio through the mediation system, yesterday heard that the Masaka Land Board in a meeting chaired by Peter Senkungu early this year, sold over 600 hectares of Mujuzi forest reserve to Kakande.
Part of that land in Buyaga village Kyanamukaka Sub county was allegedly later sold to Mbadi by Kakande. The dispute over the Mujuzi forest reserve follows a complaint by residents near the forest reserve through their councilor, Charles Zziwa challenging the acquisition of land in a forest reserve.
But hearing of the matter could not proceed because Mbadi and Kakande were not present in court. The court registrar ordered the complainants Lawyer, Jude Mbabali to inform Mbadi and Kakande to appear personally in court at the next hearing.
Both are required to furnish court with land titles, survey maps and other documents about how the disputed land was acquired. Mbadi was represented by his lawyer, Samuel Kirahe who told court that his client claims to have bought land that was not part of the forest reserve.
Residents led by Councilor Charles Zziwa vowed to fight the encroachment on Mujuzi forest Reserve.
"We are aware that the defendants have been giving bribes to those concerned in this issue especially at the district level but we shall not rest until justice is done" said Zziwa
David Kyakuwa one of the concerned residents expressed fear that trees in the disputed forest reserve were likely to be cut down. He said Masaka Senior Land Management officer, Christine Nakandi has written a letter allowing surveyors to open the boundaries for another part of the reserve for palm oil tree growing.
Nakandi in a letter dated May 8, 2015 directed the LC1 Chairman of Namirembe landing site to allow a team of surveyors from Geo-Earth consultant's surveyors to open up boundaries in Mujuzi forests reserve - the same land belonging to Kakande.
This year in May, the Masaka district speaker, Ms Phoebe Kyewalyanga suspended the district land board over corruption, abuse of office and illegally selling off Mujuzi forest reserve, swamps and open spaces in Masaka district.
