Hi Brian,
I gave up arguing the law with you when we both wasted over 30 minutes arguing whether your lawyer's motion to stop me from representing the Petitioners would succeed...then we wasted more time arguing about your lawyer's motion to dismiss our Petition. You know that judge rejected your lawyer's arguments on both those occasions. What you may not know is that several motions were filed by both sides...a simple call to the clerk can help you find out which motions have been filed independently or as part of other documents. We have also won two of your motions because your lawyer did not file documents on time.
You claim that the motion to amend was allowed as a routine. My motion was one page long but your lawyer filed 27 pages opposing the motion (local rules in Massachusetts require a maximum of 20 pages). Why did your lawyer file such a lengthy response for a motion that was doomed to fail, as you claim?

p.s I am done with this discussion...I post updates because members contact me for updates. You can also do the same thing since the suit affects members, and a current member of the Board, I think you should give updates, unprompted. After all, the members are paying your lawyer.

The only motion you won is your request to amend your complaint. These are typically and routinely granted.
The hearing on October 29, 2015 is your motion for Judgment on the Pleadings. If the Court grants that, then you 'win'. If the Court denies that, then we go to trial.
