{UAH} Gen David Sejusa Denied Bail:

This comical case has made me laugh. Here is an arguement presented to
court for refusing Mr Tinyefunza bail:
"Prosecution alleges that being a senior army officer at such a high
rank, none his sureties would be able to restrain him if he wanted to
jump bail."
I never knew that ability to physically restrain an accused is now a
condition for bail. Ability to be or not to be restrained is normally
considered in Mental Health Reviews which have to decide whether it is
safe to release a patient into the community- ie it is part of the
risk assessment of the individual to ensure he will not be a danger to
the public or to himself.
As a serving Lt. Colonel, Tony Owana would find it very difficult to
have any sureties, were he to appear before these kangaroo courts, as
Robert Atuhairwe is of very low rank in the ISO.

Former head of intelligence Gen David Sejusa has been remanded back to
Luzira prison after court rejected his quest to be granted bail.
Gen Sejusa had early this month through his lawyers David Mushabe and
Ladislaus Rwakafuuzi argued that it is his constitutional right to be
granted bail, adding that this can only be denied if public interest
requires that he stays in jail.
The defense lawyers also told court that the senior UPDF officer is of
advanced age having clocked 62 years, on top of being the sole bread
winner for his family which necessitates that he is released
temporarily.
In the bail application hearing at the General Court Martial in
Makindye this morning, Chairman Maj. Gen Levi Karuhanga declined to
grant him bail on the submission of prosecution that at least one of
his sureties should have been at the rank of General.
Gen. Sejusa presented 2 sureties including Kampala Lord Mayor Erias
Lukwago and a one Dr. Deo Kizito a surgeon at Case Medical centre who
presented themselves as friends to the accused.
Prosecution alleges that being a senior army officer at such a high
rank, none his sureties would be able to restrain him if he wanted to

The court Chairman also ruled that given his rank and the fact that he
was once in exile in the UK, if released there were many chances that
he would flee the country.
The court martial adjourned the court hearing to March 11th, and
remanded Sejusa back Luzira Pri
