Here is the immediate impact of the Supreme Court decision made in February moreorless abolishing the doctrine of joint enterprise. Here Somali gangsters murdered a person in a housing estate in Woolwich, South East London, nearly a quarter of whose residents are Ugandans. It is the poorest and most deprived housing estate in South London. The Court ruled here that it is only the person who used the lethal weapon who is quilty, not the members of the gang, who were all acquitted.
Joint Enterprise was the biggest weapon the police had for controlling gang violence because it would enable them to put 10 or 15 gangsters behind bars for very long stretches, even though only one may have inflicted the fatal injury. Now the police and prosecution have to prove that each and every member of the gang intended the consequence; ie that a person would be killed, a near impossible task.
I think in part the Courts are using judicial power to force the government to address the causes of gang crime. Indeed the Supreme Court said in its judgement that UK prisons so far have totally failed to reform criminals, young people jailed come out worse and most return to prison within 6 months of release. The courts want the government to try new approaches to youth crime rather than locking them up in jail.
