{UAH} Court Dismisses Museveni Age Case 0

The high court civil division has dismissed an application where three people were seeking an injunction blocking President Museveni from swearing in as newly elect president on condition that that he was voted illegally due to his old age.
The application was filed by Moses Bigirwa, Hakim Kiiza and Musa Lusembo challenging the age of president Museveni claiming that he is 79 years beyond the mandatory 75 years.
While delivering his verdict, justice Musota noted that the applicants failed to catch up with time since the validity of presidential elections petition are only heard in Supreme Court yet time required to handle such case had elapsed.
"This case lacks merit since it abuses court process and therefore is dismissed on costs "he ruled
Musota added that according to the constitution, the president of the republic of Uganda while holding an office is not liable to stand in court as a respondent and that this can only happen in Supreme Court
The applicants had lodged in a court seeking an injunction restraining President Museveni from swearing in before he goes through a medical examination to weigh his structural bones and strength so as to determine his age scientifically.
In their evidence, applicants claimed that president Museveni was above the constitutionally mandatory 75 years for anyone is legible to stand as a president of Uganda.
The application also mentioned various scenarios that proved that Museveni participated in the general elections of 1961 as a voter who supported Ben Kiwanuka of DP when he was 23years and that after 5years in bush, in 1986 he captured power from Gen Tito OkelloLutwa when he was 48years old.
It was on this ground that Justice Musota dismissed the case and asked the applicants to compensate all costs in the case to the respondent.
