Uganda: MP Akena, Bossa Fight Over UPC Bank Accounts

Kampala — The Uganda People's Congress Party (UPC) rival factions of Lira Municipality MP Jimmy Akena and interim party leader Joseph Bossa are embroiled in a dispute over the control of the UPC bank accounts.

During the hearing of an application filed by Mr Akena on Tuesday, his lawyers asked the Court of Appeal to stop Orient Bank from blocking them from accessing the UPC account.

On December 11, 2015, High Court Judge Yasin Nyanzi nullified the disputed election of Mr Akena as the UPC president and ordered fresh elections as per the party rules.

Mr Akena appealed to the ruling in the Court of Appeal where it's still pending.

On April 4, Mr Akena's lawyers wrote to deputy chief Justice Steven Kavuma asking him to "clarify in succinct terms, the status quo that was maintained in the [court] order and whether it extends to restraining the bank's action."

"... Orient Bank Limited where our clients operate an account has in contempt of court of the said order blocked our clients and the mandated persons from operating the said account despite our client's clear explanation that such action would tantamount to contempt of the court order," reads the lawyers' letter to Justice Kavuma.

However in response, Mr Bossa's lawyer Mr Kavuma Kabenge asked the court to instead expedite the appeal on the Justice Nyanzi's judgement.

Mr Kabenge said the issue of the UPC bank accounts is pending resolution before the Commercial Court and any decision by the Court of Appeal would amount to interference with the proceedings in the subordinate court.

On August 23, Mr Bbosa's lawyers wrote to the same Justice Kavuma saying there were a lot of issues in UPC, which require urgent attention and action by court but given the pending appeal on the issues, a decision cannot be taken or be acted upon now.
