{UAH} EXPANSION OF KAMPALA UNCONSTITUIONAL

EXPANDING KAMPALA BOUNDARIES IS UNCONSTITUIONAL

l am here by writing to react on resignation of deputy Executive
Director of Kampala Capital City Authority Dr. Judith Tumusiime as
reported in New Vision of Monday October 31st 2016.
In a letter to President Yoweri Museveni who is the appointing
authority, she gave several reasons including "Political expediency
from certain quarters." However my interest is where she would like
KCCA to be run like a parasitatal and to expand the political and
commercial capital to include the rest of Kampala Metropolitan
(including Wakiso, Mpigi and Mukono districts(.
According to Article One of the Constitution which stipulates that
sovereignty is vested in the people, any attempt to de-emphranchise
the citizens of Kampala is unconstitutional. Yes under Chapter Two of
the constitution, Kampala, which is located in Buganda is vested under
Central Government, but the people of Kampala have the right to elect
their leaders.
Secondly, under Chapter two, the boundaries of Kampala are defined and
hence, the political and commercial capital can not extend to cover
Wakiso, Mpigi and Mukono which are not directly under the control of
Central Government and which are part of the districts of Buganda that
are deemed to have agreed to form a regional Government with the
capital at Mmengo Municipality according to Article 178 of the
constitution
In the case of Wakiso District which is over two million people
according to results of 2013 national population and housing census,
plans are in progress to make it a city and this is what the President
promised during a public rally he held at Kyengera Town Council in
February at peak of presidential campaign. The District Council had
already passed a resolution supporting the city status, so is the
District Conference, of the ruling NRM party.
In my view, Wakiso is not for only one city, compared to other cities
government is considering to create , including Jinja, Mbale, Gulu,
Arua, Fort Portal, Mbarara, Masaka, and Nakasongola (Nakasongola, as a
future political capital(, as most of those towns are only 100,000
people strong or even less save Mbarara which is 250,000.
Under the colonial policy, one of the qualifications for a city status
was a population size of 500,000 people but even if this is reduced to
350,000, as it is proposed in some quarters, none is eligible other
than Wakiso.
Therefore, l propose that Wakiso should be divided into four cities;
Entebbe, Wakiso, Nabweru and Kira,
each with a population size of at least 500,000 people. Entebbe should include
Makindye Ssaabagabo Municipality which is almost 300,000, Entebbe
Municipality which is 100,000 and Busiro South including Katabi and
Kajjansi town councils and Kasanje Sub County which is 230,000.Entebbe
was the political capital for Uganda Protectorate for 70 years.
Wakiso City that should include Wakiso Sub County which is 200,000,
Wakiso Town Council, Mende Sub County, Kyengera Town Council and the
entire Busiro East constituency which is over 500,000.
Nabweru City covering Nansana Mucipality which is over 380,000 and
Busiro North including Kakiri Sub County, Kakiri Town Council,
Masuuliita and Namayumba sub counties.
Kira City which should cover Kira Municipality and Kasangati Town
Council, which is almost 500,000.
In the actual fact, it was unfair for Kasangati to be made a town
council other than a municipality, so are Kyengera which is 200,000,
and Katabi and Kajjansi when there are some municipalities whose
population size is only 10,000.
It was equally unfair for Makindye Ssaabagabo Municipality which is
almost 300,000 and Nansana Municipality which is almost 400,000 each
to remain one constituency when the population size for the
constituency is 100,000.
How can over two million people in Wakiso District be represented by
only one District Woman MP?
However the proposed Entebbe, Wakiso, Nabweru and Kira cities, just
like Mpigii and Mukono districts, should remain part of Kampala
Metropolitan Planning Authority not KCCA.
Finally, as the President , in his last meeting with KCCA leaders,
directed that street vendors be allocated stalls in Usafi , Wandegeya
and other markets in the city, these should be free of charge since
USAFI was bought by KCCA sung taxpayers' money and Wandegeya was built
on a loan from Africa development Bank which will be paid by tax
payers. There should be no middle men and women who are said to have
hi jacked the stalls in those markets as it was the case with old KCC
in St. Balikuddembe Market Owino.
