- When Raila Odinga takes his appeal to the Supreme Court to challenge Uhuru Kenyatta's win, he will have to prove that the win was not legitimate

- One of the key parts of his evidence will be the fact that the IEBC has unable to avail the Form 34A 's as requested by the opposition

- This means that both the provisional and final results announced last week are null and void and that Uhuru Kenyatta was not lawfully declared winner.

- Then there was the phenomenon of Uhuru Kenyatta's lead staying at around a consistent 11 percent throughout the transmission of the results

The National Super Alliance brigade have changed their minds and will file a case at the Supreme Court to petition President Uhuru Kenyatta's win.

Led by the opposition's presidential candidate in the Tuesday, August 8, election, NASA rejected the provisional and final presidential election results, claiming that the winners had been computer generated.

They claimed the Independent Electoral and Boundaries Commission's systems were hacked to give Uhuru a win.

Among the evidence NASA intends on tabling in court is the fact that the IEBC streamed the presidential results without them being backed up by Form 34 As.

These forms are the final tally from polling stations and then, are tallied again and recorded in Form 34Bs.

Days after Uhuru was declared the winner, Returning Officers were still handing in their forms and when NASA asked for them to compare them with their parallel tallies, IEBC said they couldn't hand over the forms.

Uhuru was declared president with unconfirmed results and Wednesday, August 16, was when IEBC announced they had received all the forms.

"From the start, the IEBC was illegally releasing unverified results to create the expectation of an Uhuru Kenyatta victory. only about 29,000 of the 41,000 verified Forms 34 As had been tallied! This was the equivalent of guaranteeing violence if the final verified results indicated Uhuru had lost," said Raila Odinga at NASA's presser on Wednesday, August 16.

NASA will also table evidence of an algorithm introduced into the IEBC's system that gave Uhuru Kenyatta a constant 11% win over Raila. The final tally had Uhuru winning 54% of the votes and Raila 44%.

"Then there was the bizarre phenomenon of Uhuru Kenyatta's "lead" staying at around a consistent 11 percent throughout the release of the "results!" surprisingly, this same pattern also occurred in many gubernatorial races across the country," added Raila.

Raila also noted that the same percentage difference was noted in the gubernatorial races across the country.

"Such a fixed margin has never been maintained throughout any democratic election anywhere in the world. But it happened here because an algorithm had been introduced to rig the outcome. It happened in full view of all our people and all the election observers,

"Although election day voting and counting processes functioned smoothly, the electronic transmission of results from the polling stations to the 290 constituency centers, where official results are tallied, proved unreliable," concluded Raila.
