- IEBC is ready to allow NASA access to original forms 34 A and B under the supervision of the Supreme Court

- However, Uhuru's lawyers have objected the decision saying it will prejudice their client

- NASA wants the forms to anchor their evidence in the petition they filed

President Uhuru Kenyatta's lawyers have objected the decision by the Independent Electoral and Boundaries Commission (IEBC) to allow NASA access to the original forms 34A.

In a pre-trial sitting held by Supreme Court on the evening of Saturday, August 26, IEBC lawyer Paul Muite told the seven-judge bench that the commission is ready to allow NASA access to the original forms 34A but under the supervision of the Supreme Court.

Muite further told the court that the electoral body cannot allow the opposition (petitioner) access to the IEBC servers due to time constraints and for fear of compromising security.

But President Uhuru Kenyatta's lawyer Ahamednasir Abdullahi objected the move to allow NASA access to the forms saying the decision will prejudice his client.

NASA hd asked the court to compel the electoral body to submit forms 34 A and B and allow access to their servers as part of evidence to sustain their petition.

IEBC had refused to give NASA the forms even after the commission received official communication from the opposition.

NASA believes IEBC deliberately declared Uhuru winner of the August 8 polls relying on the results transmitted through its system and not backed by the said forms.

The hearing of the petition begins Sunday, August 27, at 3 pm.
