Commercial Court has disqualified law firms of MMAKS advocates and AFK Mpanga advocates from representing BOU against businessman Sudhir Ruparelia over conflict of interest.

Court held that they are privy to confidential information regarding Sudhir so for them to represent BoU against him would be to his disadvantage.

They have been his lawyers for the last 12 years.

The ruling was read out by deputy registrar Lillian Bucyana on behalf of justice David Wangutusi.

"In summary, the 1st and 2nd respondents (Timothy Masembe Kanyerezi and David Mpanga) represented Mr Ruparelia and he is their former client, so representing the current client (BoU) would be advantageous to them," ruled justice David Wangutusi

"In the result, the 1st and 2nd respondents are disqualified as being counsel for BoU. application is allowed and costs shall abide in the main case,"

As the ruling was being read, the two affected lawyers were not present in court.

Sudhir was personally in court and shortly after the ruling, he said he would lodge a complaint with the law society of England where one of the conflicted lawyers is a member so that he is exposed.

MMAKS Advocates through Moses Adriko, revealed to court that they are going to appeal before close of business today
