{UAH} Gina Miller’s court bid to stop suspension of parliament
CAMPAIGNER Gina Miller's High Court bid to challenge Boris Johnson proroguing parliament is 'being considered', the judiciary has said.
An urgent application for a judicial review was made by Ms Miller, who previously won a landmark ruling that MPs would have to vote before the government could invoke Article 50 to formally start the UK's exit process from the EU.
In a statement, she said: 'It cannot be legitimate or a proper use of the prerogative power to prorogue parliament when the intention and effect inherent in doing so is to frustrate parliament and fetter it from exercising its sovereign right to fulfil its elective role and enact any law it sees fit.'
The judiciary confirmed her application had been received, adding: 'The defendant is the prime minister. The application is being considered.' Meanwhile, another legal bid on the same topic began in Scotland's highest civil court yesterday.
A cross-party group of around 70 MPs and peers are backing the action at the Court of Session in Edinburgh after filing a petition earlier in the summer. They want an interim interdict, which would stop the suspension until a final decision on the case.
■ WITH a snap election possibly on the cards, political parties were boosted by £15million of donations between April and June, more than double the figure for the first quarter. The Conservatives were handed £5,428,457, Labour received £5,064,718, the Lib Dems got £1,909,186 and the Brexit Party's war chest swelled by £1,049,000, the Electoral Commission said.
