DOES THE PRESIDENT HAVE POWERS TO REJECT OUR LAWS?

For those who read the news, you know that last month the President of the Republic of Uganda, rejected two bills, the Minimum Wages Bill and the GMO Bill because he felt that the existing laws are enough to handle the issues of pay and the GMO Bill had many gaps.

does the President have powers to reject a law, and what happens next when MPs at Parliament (located next to the National Theater. Sometimes, its hard to tell where much of the comedy happens, the National theater on Thursday or Parliament ) but anyway, lets go back to our legal things that we want to teach you, and which we know you very much want to learn ?

WHAT DOES THE CONSTITUTION SAY:

The Constitution says that Parliament is the one in charge of making or changing laws. A law comes to Parliament in what is called a Bill. Parliament then reads the Bill and debates it at least 3 times before it can be passed to become a law. When this is done, it goes to the President of our country for signing. This is called Assent.

WHAT DOES THE PRESIDENT HAVE TO DO WITH LAWS?

The President decides if the law is ready to be law by signing or advising Parliament on what it has missed out. if he finds the bill covers everything, then he signs and it will become a law for all of us. if not, then he sends it back to Parliament telling them what they should change for it to be ready for him to look at again.

BUT WHAT HAPPENS IF HE CONTINUES TO REFUSE?

Hmmm... Since a country must have laws and the MPs are supposed to represent what people want, the Highest law in Uganda (the Constitution) allows Parliament to pass the bill into law if the President continues refusing after they have brought it to him twice. This can be done if 2/3 of the MPs vote and say yes to the bill.

So in this case, since the GMO Bill has been refused twice by the President, then the Parliament can choose to pass it if 2/3 of MPs say it is passed as law.

WHAT ABOUT THE MINIMUM WAGES BILL?

Since it is the first time it has been rejected, the MPs can make a few changes to the Bill and pass it and send it back to the President to sign. If he rejects it again, then the same process can follow.

In a nutshell, what we are saying is that if the President fails to sign an act into Law, then Parliament can still bypass the President by voting to pass this into law if 2/3rds of the MPs vote in favour of passing the law.

We wait to see what approach our chosen representatives shall take with regard to the two rejected bills.
