{UAH} The Law of the Land is supreme

Onen, Adokorach's husband had been begged on many occasions to write a will. He kept saying that writing a will, would bring him bad luck. Unfortunately, he was knocked dead by a trailer at Corner Kamdini.

On the evening of his burial, a clan meeting was held. Adokorach and her 3 daughters were denied access to the meeting because they are women and according to the clan members, 'they know nothing'. Her 8-year-old son was also left out of the meeting because he is too young to make any sensible decisions. In the meeting, her eldest brother-in-law was named customary heir and given all the land her husband bought in Awach, while his younger brother was given the Late's bicycle as a gift. It was also agreed that Adokorach was to go back to her maternal home since her husband had died.

The Law of Uganda provides that when a person dies, the very first person who has the right to inherit that Late's property is their spouse. This means that the wife should be the primary beneficiary to the estate of her late of late husband and not a brother to the late husband. It is worth noting that this principle cuts across to women also. If a wife died, the first person that is supposed to benefit from her estate is her husband.

Therefore, as per the law, Adokorach is the rightful primary beneficiary of the Late Onen's estate. She should not be denied the property as this would be illegal.

That said, the law also provides that any child may benefit from the estate of their late parent. The law does not discriminate between male or female but rather that any child may benefit. Consequently, the three daughters and son must be allowed to inherit from the late Onen's estate.

As such, to ensure that such inheritance is proper and legal, Adokorach should apply for letters of administration from the court to properly administer the estate of the Late Onen. However, in Acoli culture, its assumed that the brothers of the deceased will look after those kids. Some women also go away and marry else where leaving the kids at the late husband's home.
