Bibanja/Kibanja/ Purchase agreements :
Whenever you intend to buy a Kibanja or "poloti" from a Kibanja owner, see to it that the person selling to you that kibanja has got the consent of the LandLord (The actual owner of the said land with the mother title). If the seller doesn't show interest to notify the owner, suggest it to him /her before you pay. In most cases, bibanja owners who intend to sell DO NOT WANT to notify the landlord because of the landlord 's "Cut" , and because the buyers are ignorant of the importance of the landlord 's consent in the whole thing, they don't insist.
Without this consent, your purchase agreement is considered INVALID by law. At a later stage when the landlord may finally feel like using his land or selling it, you wont be eligible to compensation (as rightful kibanja owners are) and you stand a risk of being evicted in disgrace ESPECIALLY if your fake (yes, fake) "agreement" is not more than 12 years.
