The Mukono municipality woman MP Hon Betty Nambooze is so disappointed in Uganda government for not helping singer Eddy Kenzo who is currently stranded in Ivory coast
:TO WHOM IT MAY CONCERN:
Our star, the only one we have as a Country in that category is stranded in Ivory coast after the lockdown of countries due to Coronavirus got him there. There are so many other people stranded like Eddy Kenzo and we send our sympathies to them.
I have always cautioned the leaders of this country that we are not handling the Music and showbizz industry well. We havent taught our young people how stars are supposed to behave. We havent raised a demand on them to be managed by proffesionals. When they go for international tours these young people fly our our country's flag which means that they are on National duty...they bring both fame and money to our Country. They are the unpaid ambassodors and real assets for Uganda.
A while ago,I read a statement by Kenzo on how he found himself in Ivory coast in this period when Coronavirus is ravenging Nations. For now, Ivory coast is one of the most hit Nations in Africa. Kenzo properly admits that he travelled at a big risk but he couldn't afford to refund the payements and expenditures made by the organisers of the concerts.
If Kenzo was under a serious management he wouldnt have travelled for an international concert in this period. His fear of getting sued by the organisers of the tour is out of incomprehension of the principals of the law and this is why we should demand that stars of Kenzo's calibre must be supervised by a team of proffesionals.
In the law of contracts, an act of God is interpreted as an implied defense under the rule of impossibility or impracticability. If so, the promise is discharged because of unforeseen occurrences, which were unavoidable and would result in insurmountable delay, expense, or other material breach. No person can sue the other upon a breach resulting from an ACT OF GOD and am alerting all people not to allow others to harass them over contracts flopping due to the Coronavirus.
This principal was formed in 1863, in the case of Taylor v Caldwell which introduced the doctrine of frustration of contract, that provides that "where a contract becomes impossible to perform and neither party is at fault, both parties are excused of their obligations". In this particular case, a music hall was burnt down by act of God before a contract of hire could be fulfilled, and the court deemed the contract frustrated.
To Uganda,I say that we dont have many people of Kenzo's type. Its so cruel of us to pretend not to hear his appeals. Maybe it is very late now but atleast lets our foreign Minister contact his counterpart in Ivory coast to ensure the safety of "Kaana ka mbata" for we cant afford to bear the consequences should Kenzo get a problem in a foreign land. I further call upon Ssebo Owekitiibwa ennyo Samuel Kahamba Kuteesa to reach out to Ugandans who maybe stranded in various Countries and arrange with or request Governments were they are to ensure their safety...THAT IS WHAT GOVERNMENT ARE FOR ,
