IS IT LEGAL FOR ME TO MARRY SOMEONE WHO IS 16 YEARS IF CULTURE ALLOWS IT?
Uganda is a very diverse country with many cultures. Culture is very important and most people in the country greatly accept and embrace it. It is also recognized in the Constitution.
However, there are some cultural practices that go against the Constitution. Some of these cultural practices relate to marriage. In many cultures, from the moment a girl gets her first period she is ready for marriage, and some laws such as the Customary Marriage Act provide for the marriage age as being 16 years.
The challenge is that, marriage requires consummation both in culture and law but our Constitution says that sexual intercourse with a person under the age of 18 years is defilement which has a punishment of life imprisonment.
Criminal law also states that the marriage age is 18 years and above.
This brings up a bit of a conflict in the laws; if a man marries a 16 year old girl in accordance with the Customary Marriage Act, is that couple lawfully married given that the Constitution provides for 18 years?
Is the marriage okay as long as the couple remains "dormant" until the wife turns 18 years?
