{UAH} LAWYERS INTIMIDATING ME OVER CHURCH MONEY - ARCHBISHOP LWANGA

Kampala Archbishop Dr. Cyprian Kizito Lwanga has been living in fear after the
Government paid part of the money as compensation for the church land used to
expand the Entebbe Expressway in Munyonyo.
According to the prelate, lawyers Kihika Byenkya, Gordon Bainomugisha and Julius
Galisonga are asking him for sh9.6b for the help they rendered in recovering the
compensation.
Lwanga says Byenkya wants sh920.4m; Bainomugisha, the son of former
state tourism
minister Serapio Rukundo, is demanding sh3.4b, while Galisonga wants sh5.29b.
He says if the total of sh9.6b is removed from sh17.6b that the church
received, the
archdiocese would be left with nothing to cater for its needs.
"The court cases are putting my life in danger and also tarnishing the
good image of the

Government which seems to let go of such forgeries. I, therefore,
request you to bring
the lawyers to book after having misguided me through the whole
process, intimidating
me, putting me under unnecessary pressure and taking advantage of my lack of
information about how the Government procedure operates," he wrote to
the President.
Lwanga says the lawyers misguided him into signing instructions for them to get
payment from the Government concerning the compensation of church land
at Entebbe
Airport and Nsambya, which the Police is currently occupying.
"As you recall in our meeting held on Wednesday, November 27, 2019 at
State House
Entebbe where I brought to your attention the lawyers who misguided me
into signing
instructions for them as the only option for the Archdiocese to get payment from
Government in regard to the compensation of the church land," he reminded the
President.
Lwanga says on learning it is government officials who handle
presidential directives,
he retracted all the instructions from the lawyers, stopping them from
pursuing the
matter further.
In a letter dated May 21, 2020, addressed to President Yoweri
Museveni, Lwanga says
to his surprise when he went abroad for official duties, Byenkya
convinced the Vicar
General, (name not mentioned) that the archdiocese would miss out on
the payment if
his instructions were not reinstated.
Lwanga says Byenkya wrote to the lands minister, guiding that church
funds be sent on
the account of Byenkya, Kihika & Co.
Advocates, in the United Bank of Africa (Uganda) Ltd account number 016000879 at
Jinja Road Branch.
Lwanga says Byenkya demanded 25% of the money the church had received.
"Although I had blocked his instructions to have the money put on his
account, I paid
him what I could afford. However, he has continuously kept harassing and
humiliating me both in the newspapers and court," Dr. Lwanga lamented.
According to the letter, the lawyers filed cases at the High Court,
demanding for the
money.
The cases were filed in 2018, 2019 and 2020, respectively.
In a suit filed at the Civil Division of the High Court in Kampala on
May 11, Galisonga
and Company Advocates seeks orders that the court taxes the bill
between herself and
the Registered Trustees of the Archdiocese.
The law firm contends that it was instructed to recover sh17.6b, an
outstanding balance
arising out of ground rent arrears and/ or mesne profits for the land
comprised in
LRV528 and LRV418 Folio 15 land at Nsambya.
However, the law firm states that it recovered the amount and demanded
for legal fees,
but the archdiocese trustees ignored the same. Court documents
indicate that the law
firm was supposed to be paid sh5.29b in legal fees.
Lwanga asked the President to intervene in the matter, saying the
mentioned lawyers
are dishonest.
The Catholic Church leader says he had instructed Muhumbura & Company Advocates
to take on these lawyers, but it seems the matters will not end and
they might never get
justice. He says the new legal firm is still finding it hard to
represent the church.
Lwanga requested the President to bring the lawyers to book after
having misguided
him through the whole process, intimidating him and putting him under
pressure and
taking advantage of his lack of information on how government
procedures operate.
Lwanga says because of the pressure, he paid Bainomugisha sh5b out of
the sh20.5b,
which the Government compensated the church for the Entebbe land and one
identified as Martin Kasule sh2.5b, to cater for legal expenses, which
they claimed to
have incurred together with his colleagues.
He also reveals that when Government paid the church sh12.8b, as the
first installment
for Nsambya land, the church deposited sh2.6b on the account of
Archdiocesan lawyer
Buwuule and Mayiga Company Advocates.
Lwanga says they agreed that Francis Buwuule and Martin Kasule would
use the money
for clearing all the lawyers who claimed to have taken part in influencing the
Government to pay the church.
Lwanga also said he has never interfaced with Galisonga of Galisonga and Company
Advocates, saying the lawyer was recommend to him by Martin Kasule,
who allegedly
works with a Centenary Bank official, who gives him details whenever
there is any
transaction.
He says Kasule and his colleagues are putting him on pressure and
threatening his
bankers.
In the letter, Lwanga thanked President Museveni for the job done in
the fight against
COVID-19 pandemic.
